GI Legislation in India
The TRIPS prescribes minimum standards under Article 22 to 24 of Section III to protect geographical indications. India in compliance with TRIPS, enacted the Geographical Indications of Goods (Registration and Protection) Act, 1999, which came into effect on 15th September 2003, and the Geographical Indications of Goods (Registration and Protection) Rules, 2002.
The objective of the GI Act is to provide better legal protection in respect of GIs, prevent unauthorized persons from misusing and deceiving consumers, also, to promote goods bearing the Indian GI tag in the global market.
